Nursing Home fees victory for families

Nursing Home fees victory for families

The question of when the NHS should pay for Nursing home costs has been further clarified in a groundbreaking case.  Long term care in Nursing Homes will increasingly be paid for by the NHS after a recent case in Wirral.  It is estimated that around 100k people are currently paying for care that should be NHS funded, with fees being reimbursed to the tune of several hundred thousand pounds in some cases.

The case has implications for some nursing home residents and their families, and of course also for PCT budgets.  The implications for nursing homes themselves are less obvious, though may make the relationship with families a little easier if the bills are being covered by a third party.

It should be noted that case law is not yet fully established and back-payments will be far from automatic, though the current case appears to strengthen precedent and likely outcome of many of the 750 cases still being appealed.
